Austin,
That doesn't sound like a product that I'd want to sell. You named 2 major problems with it right off the bat.

Last week when collecting, I found one of those pods in all 6 East facing Horizon soap compartments. They were intact for the most part, but leaking the fluid. That was a first for me with these pods. Les

I've been lucky so far as I haven't found any of the Tide pods in the soap compartments. Most of the customers throw them in the tubs or ask me where they should put them. One woman found that her clothes came out a little cleaner when she placed the pod at the bottom of the washer instead of placing it on top of her clothing. I guess that the soap dissolves faster and has more time to clean.

Oh wow! What a great idea! They come in that nice looking plastic container, which would be perfect for a counter display! I am stealing this idea TODAY Thanks!

There's actually a "self-funded" county government office here that sends an inspector out to stores looking for resale of items "not labeled for individual sale." (Their salary and office expenses are funded entirely out of the fines they collect, so they're motivated to actively seek out violations of labeling policy.)
If a snack item doesn't have the proper USDA nutritional labeling in a vending machine, there's a fine to the operator. Often times Costco or the local restaurant supply sell bulk packages of items with the proper labeling on the main outside package, but not on each individual unit.
I bring this up because of the recent flak P&G received over children eating the brightly colored Tide pods. We're experimenting with their use for WDF, and I've already been warned that they're not labeled for individual sale.

That would have to be a hell of a lot of fines written, or the amount per fine huge, to self fund. You'd think after being caught once and paying a fine the potential violators would dwindle to one here one there, not enough to generate a lot of revenue from such a specific source. Even many parking ticket programs don't self fund!

That's why our nanny-state government folks keep finding new things to "protect us from"... The agency writing tickets for improper retail labeling is the same agency that writes parking tickets in the core of downtown. In the past few years, they've also added handicapped parking enforcement, video game permit compliance and a few others.

Chase;
How do you know they are self funded? I have doubts that with all the insurance benefits labor, gas vehicle expense, retirement packages, etc. How could they be self funded?!
Must be some hsfty fines.
